Website general conditions of use

The access, use and any other fruition of the website https://www.irondames.shop (hereinafter, the "Store"), imply the knowledge and acceptance of these general conditions of use of the Store (hereinafter, the "Conditions of Use") by those who interact with it (hereinafter, "Users"or even only in the singular form "User").

Should the User intend not to accept, in whole or in part, these Conditions of Use, the latter is encouraged to leave the Store and not use its services and/or features. In addition to that, any material downloaded or printed from the Store shall be immediately destroyed.

The Data Controller (as defined below) shall be entitled to make any changes to the Store at any time and without any obligation to notify nor assuming any responsibility for failure to update the contents of the Store.

2. PURPOSE AND USE OF THE STORE

The purpose of the Store is to provide information about the Data Controller and the products commercialized by the latter through the same.

Access to and navigation on the Store are free of charge and do not depend on the creation of a customer account by the User. In any event, for the purpose of purchasing products in the Store, the User may create a customer account, although the creation of such an account is not mandatory for the said purpose.

3. RECIPIENTS

Users are solely responsible for the truthfulness, correctness and completeness of the information provided while browsing the Store and, in particular, when filling in the forms available on the Store or when creating a customer account.

4. INTELLECTUAL PROPERTY RIGHTS

The Data Controller is the exclusive owner or licensee of any intellectual or industrial property rights (hereinafter, "IP Rights" or even only in the singular form "IP Right") relating to the Store, including but not limited to, trademarks, logos and any other distinctive marks, creative works such as text, photographs, images, layouts, graphics, illustrations, graphics, videos and documents (hereinafter, the "Materials").

Unless otherwise expressly agreed in writing, nothing in these Conditions of Use shall be construed as an assignment or grant of any license and/or authorization to any IP Right.

Users are authorized to view, print, download, and use the Materials for informational use only, provided that such activities are performed in compliance with these Conditions of Use.

Except as expressly permitted in these Conditions of Use, the Store and Materials may not be modified, altered, reproduced, transferred, copied, published or otherwise distributed, in any form or by any means, without the prior written permission of the Data Controller. Authorization - to be applied for by contacting the Data Controller through the contact details indicated above - will be granted at the sole discretion of the Data Controller and always on the condition that the operational acts applied for pursue lawful purposes.

In the event of a violation of this article, the Data Controller shall have the right to take action before the competent national or international authorities in order to safeguard its rights against the violator.

5. PERSONAL DATA PROTECTION, COOKIE POLICY, AND STORE SECURITY

The processing of the User's personal data by the Data Controller is carried out in accordance with the provisions set out in the Privacy Policy of the Store and available on the same.

The Store may contain hyperlinks (hereinafter, "Links") to web pages, platforms, or social networks external to the Store, including through social button or widget type buttons. Such Links are included to ease Users in their browsing activity, facilitating hyperlinks to online information deemed useful and/or relevant. The activation of such links represents a mere indication of the Data Controller to simplify access to such external websites and does not imply any guarantee or responsibility for their contents, especially for the goods and/or services promoted and/or offered therein.

The Data Controller does not control nor perform or have the obligation to perform, generalized and constant monitoring and/or control operations on external websites and their contents, which could be changed at any time by their respective data controllers.

Except in cases of willful misconduct or gross negligence, the Data Controller shall not and can never be held responsible for the contents of external websites, especially with regard to the processing of personal data during browsing operations.

The User hereby acknowledges that these Conditions of Use in no way govern the use of websites other than the Store.

If such Links constitute unfair or unjust business practices or result in one or more violations of IP Rights, the Data Controller has the right to block and/or remove such links to the Store.

In any case, the activation of deep hyperlinks to the Store, such as embedding, online linking, or other types of deeplinking - hotlinking, including, certain types of framing, such as the unauthorized use of meta-tags/Keywords that contain and/or reproduce distinctive marks of the Data Controller is prohibited.
Moreover, any form of web scraping is prohibited.

7. LIMITATIONS OF LIABILITY

By accessing the Store, Users shall be solely responsible for its use, as well as for the use of the Materials contained therein.

Users will be solely responsible for any communication of information and/or data that is incorrect, false, or referable to third parties in the absence, where required, of their consent, as well as for any use of the Store that does not conform to the principles of fairness and good faith.

Except in cases of willful misconduct or gross negligence, any liability for damages, direct or indirect, to computers, software, and/or loss of data caused by the downloading of Materials freely downloaded by Users shall fall on the Users and shall never be attributed to the Data Controller.

The Data Controller hereby denies any liability for any damages, direct or indirect, related to the malfunction, suspension, interruption or otherwise inaccessibility to the Store and its contents, attributable to force majeure or fortuitous event.

Except in cases of willful misconduct or gross negligence, the Data Controller shall not be liable for any damages caused by viruses, malware, damaged files, errors, omissions, deletions attributable to third parties, or otherwise related to the network, provider, or telephone, and/or telematic, and/or electrical connections nor for erroneous use of the Store or Materials by Users.

Without prejudice to the adoption of appropriate technical and organizational security measures referred to in Article 5, the Data Controller declines any responsibility for damages related to any unauthorized access to the Store by third parties and related alterations, as well as failure and/or malfunction of the hardware or software of the Users themselves.

In any case, the Data Controller shall never be liable for damages caused to third parties as a result of the User's unlawful use of the Store.

8. UPDATE OF THESE CONDITIONS OF USE

The Data Controller reserves the right to unilaterally amend these Conditions of Use at any time. The new version of the Conditions of Use will be posted on the Store and the use of the Store following the changes will imply the acceptance by the User of those changes. It will be User's responsibility to check the Store for the latest updated version of the Conditions of Use.
